D.M.-- No. We are talking about a case involving the death of one of the spouses in a presumptively sacramental marriage who had been living separate lives through legal divorce. Death ends a sacramental marriage, which frees the surviving spouse to remarry. There is no reason or need to have such a marriage declared null from the beginning through annulment.
