Baptism
Question from Michael on 9/2/2009:

Dear Fr. A non christian party civilly married to a divorce catholic party. A non christian party asking for Baptism. Can this be done. If not why? if yes what will follow? is there any suggestion for the good of both parties

Answer by Rev. Mark J. Gantley, JCL on 9/27/2009:

Before parties can be baptized or received into the full communion of the Catholic Church, they must be in a valid marriage. Assuming that the prior marriage of the divorced Catholic was valid (in the Catholic Church), then the Catholic must petition for a declaration of nullity. If the declaration of nullity is granted, then the parties need to validate their marriage in the Catholic Church. This will result in the non-Catholic party being in a valid marriage and be eligible for baptism or reception into the full communion of the Catholic Church.
