to re-marry

If a divorced Catholic was in an invalid marriage because the couple was married in the ex-spouse's non-catholic church, will the Catholic need an annulment to marry in the Catholic Church?

Answer by Robert J. Flummerfelt, J.C.L. on 11/2/2011:

The Catholic would need certainty as to his/her freedom to marry which can be accomplished by the pastor during the premarital investigation (canons 1066-1067 of the Latin Code), or many US tribunals require even simple lack of form cases to be handled administratively by the Diocesan Tribunal or Office of Canonical Services.
